Please read these Terms of Service ("Terms") carefully before using PlaneTrader.com (the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. About PlaneTrader

PlaneTrader.com is being developed as an online marketplace for buying and selling aircraft. At this time, the Site operates in a pre-launch capacity: it allows visitors to sign up for launch notifications, submit general inquiries, and apply for Founding/Certified Dealer status. Marketplace features described on this Site (browsing listings, posting listings, saved searches, and related functionality) are not yet active and will become available as they are built and released.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use this Site. By using the Site, you represent that you meet these requirements.

3. No Marketplace Transactions (Yet)

The Site does not currently facilitate the purchase, sale, or listing of any aircraft, aircraft parts, or related goods or services. Once marketplace functionality launches, separate or additional terms may apply to listings and transactions, and PlaneTrader will not be a party to any transaction between buyers and sellers. PlaneTrader will not inspect, certify, or warrant the airworthiness, condition, title, or legal status of any aircraft listed on the Site. Buyers and sellers will be solely responsible for conducting their own due diligence, including pre-purchase inspections, title searches, and compliance with all applicable Federal Aviation Administration (FAA) regulations and other laws.

4. Founding / Certified Dealer Program

Participation in PlaneTrader's Founding Dealer, Certified Dealer, or any similar program is subject to a separate agreement, code of conduct, and membership terms, which will be provided to applicants. Submitting an inquiry or joining a waitlist does not guarantee acceptance into any such program. PlaneTrader reserves the right to accept, reject, suspend, or revoke any dealer's certification or membership at its sole discretion. Any "Certified" or similar designation reflects only that a dealer has agreed to PlaneTrader's stated code of conduct and does not constitute a guarantee, endorsement, or warranty of any dealer's conduct, inventory, or individual listings.

5. Acceptable Use

You agree not to:

• Submit false, misleading, or fraudulent information through any form on the Site.
• Attempt to interfere with, disrupt, or circumvent the security or proper functioning of the Site, including its spam- and bot-prevention measures.
• Use any automated means (bots, scrapers, or similar) to access or interact with the Site without our prior written permission.
• Use the Site for any unlawful purpose.

6. Intellectual Property

The PlaneTrader name, logo, and the content of this Site are owned by PlaneTrader or its licensors and are protected by applicable intellectual property laws. You may not use PlaneTrader's name, logo, or content without our prior written permission, except as necessary to use the Site as intended.

7. Disclaimer of Warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PLANETRADER AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL PLANETRADER'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED ONE HUNDRED DOLLARS ($100).

9. Indemnification

You agree to indemnify and hold PlaneTrader harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site or your violation of these Terms.

10. Changes to the Site or These Terms

We may modify, suspend, or discontinue the Site, or any part of it, at any time. We may also update these Terms from time to time; the "Last updated" date above reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles, and any disputes arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts located in Florida.
